CHAPTER 70: OFF-ROAD VEHICLES

§ 70.01 PURPOSE.


      This chapter is adopted in conformance with I.C. 14-16-1 to regulate the operation of off-road vehicles on the county roads.

      The definitions of various terms specified in I.C. 14-16-1 are incorporated herein by reference.

§ 70.03 AUTHORIZATION OF USE OF

CERTAIN COUNTY ROADS BY OFF-ROAD

VEHICLES.


      (A)  Off-road vehicles may be operated on county roads outside the corporate limits of any city or town, except that off-road vehicles shall not be operated on the following roads: Polk Patch Road/C.R. 1200W from C.R. 925N south approximately three miles to C.R. 650N, in Salt Creek Township.


      (B)  No person shall operate an off-road vehicle under this chapter without having a valid motor vehicle driver’s license or without a valid vehicle registration as required by I.C. 14-16-1-8.



      (C)  No use of off-road vehicles otherwise prohibited by state law shall be permitted on county roads.


      (D) A person who operates an off-road vehicle on county roads as permitted by this chapter shall comply with I.C. 14-16-1.


      (E)  A person who operates an off-road vehicle on county roads as permitted by this chapter shall have in effect at all times the minimum amount of liability insurance coverage for the off-road vehicle as required by state law for the operation of an automobile.


      (F)  Any law enforcement officer including but not limited to the County Sheriff’s Department officers, state police and state conservation officers may enforce this chapter.

§ 70.99 PENALTY.


      A person who violates the provisions of this chapter shall be liable for a judgment in favor of the county in an amount not to exceed $500 plus court costs.

      71.01     Adoption by reference




§ 71.01 ADOPTION BY REFERENCE.


      The county shall, from time to time as necessary, enact ordinances that affect the control of traffic on streets and roads within its jurisdiction. These ordinances are hereby adopted by reference into this code of ordinances as if set forth in their entirety and are available for public inspection in county offices.
